Terms of Service / End User License Agreement (EULA)

Welcome to HaloBestie. These Terms of Service and End User License Agreement (“Terms”) govern your access to and use of the HaloBestie mobile application, website, and related services (collectively, the “Service”).

By creating an account, accessing, or using the Service, you agree to be legally bound by these Terms. If you do not agree with any part of these Terms, you should not access or use the Service.

1. Description of the Service

HaloBestie provides an online platform that allows users to engage in conversations with trained peer listeners (“Besties”). The platform is designed to offer a space for individuals to share thoughts, experiences, or emotional concerns in a supportive environment.

The Service may include features such as:

  • Anonymous conversations with peer listeners
  • Scheduled or instant support sessions
  • Optional paid session extensions
  • Communication tools within the application

The Service is intended for supportive conversation purposes only.

2. Nature of the Service

HaloBestie provides peer support and conversational listening services. Besties are trained listeners but are not acting as licensed therapists, psychologists, psychiatrists, or medical professionals.

The Service does not provide medical advice, psychological diagnosis, or professional therapy.

Users should seek qualified professional help when dealing with serious medical, psychological, or psychiatric conditions.

3. Eligibility

To use the Service, you must be at least 13 years of age.

By using HaloBestie, you represent and warrant that:

  • You are at least 13 years old
  • You have the legal capacity to enter into these Terms
  • You will comply with all applicable laws and regulations

4. User Accounts

To access certain features of the Service, users may be required to create an account.

Users are responsible for:

  • Maintaining the confidentiality of their account
  • Ensuring the accuracy of account information
  • All activities that occur under their account

HaloBestie reserves the right to suspend or terminate accounts that violate these Terms or compromise the safety of the platform.

5. Anonymous Interaction

HaloBestie is designed to support anonymous communication.

Users agree not to:

  • Share personally identifiable information that may compromise their safety
  • Attempt to obtain personal identity information from other users or Besties
  • Use the platform to impersonate another individual

6. Acceptable Use Policy

Users must use the Service in a lawful and respectful manner.

The following activities are strictly prohibited:

  • Harassment, abuse, or threats toward other users or Besties
  • Hate speech or discriminatory behavior
  • Sharing illegal or harmful content
  • Promotion of violence or self-harm
  • Fraudulent activities or scams
  • Sexually explicit content involving minors
  • Attempts to exploit or manipulate other users

Violations may result in immediate suspension or termination of the account.

7. Child Safety

HaloBestie strictly prohibits any activity involving child sexual abuse or exploitation.

Content or behavior related to child exploitation will be removed immediately and may be reported to appropriate authorities when required by law.

8. Payments and Transactions

Certain features of the Service may require payment.

Payments may include:

  • Session extensions
  • Premium conversation features
  • Other optional services

All payments are processed through authorized payment providers. Prices and payment terms may change from time to time.

Unless otherwise required by law, payments for completed services are generally non-refundable.

9. Intellectual Property

All content, software, design elements, and technology associated with HaloBestie are owned by HaloBestie or its licensors.

Users may not:

  • Copy, distribute, or reproduce platform content
  • Reverse engineer the application
  • Use the Service for unauthorized commercial purposes

10. License Grant

HaloBestie grants users a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

11. Suspension and Termination

HaloBestie may suspend or terminate access to the Service at any time if users violate these Terms or engage in behavior that threatens the safety of the platform.

Users may also discontinue use of the Service at any time.

12. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis.

HaloBestie does not guarantee that the Service will be uninterrupted, error-free, or completely secure.

13. Limitation of Liability

To the maximum extent permitted by law, HaloBestie shall not be liable for indirect, incidental, consequential, or special damages arising from the use of the Service.

14. Changes to the Service

HaloBestie may modify, update, or discontinue parts of the Service at any time in order to improve functionality or comply with legal requirements.

15. Changes to These Terms

These Terms may be updated periodically. When changes occur, the updated version will be published with a revised effective date.

Continued use of the Service after updates indicates acceptance of the revised Terms.

16. Governing Law

These Terms shall be governed and interpreted in accordance with applicable laws and regulations.

By using HaloBestie, you acknowledge that you have read and agreed to these Terms of Service.

18. App Store Additional Terms

If the HaloBestie application is downloaded from the Apple App Store, the following additional terms apply:

This license is limited to a non-transferable license to use the HaloBestie application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the App Store Terms of Service.

You acknowledge that these Terms are concluded between you and HaloBestie, and not with Apple Inc.

HaloBestie, and not Apple, is solely responsible for the Service and its content.

Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the application.

In the event of any failure of the application to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price for the application where applicable. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the application.

Apple is not responsible for addressing any claims by users or third parties relating to the application or the user's possession and use of the application.

This includes but is not limited to:

  • Product liability claims
  • Claims that the application fails to conform to legal or regulatory requirements
  • Claims arising under consumer protection or similar legislation

You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country and that you are not listed on any U.S. Government list of prohibited or restricted parties.

You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these Terms and that Apple will have the right to enforce these Terms against you as a third-party beneficiary.
